| 内容記述 | 本研究では、親権及び面会交流の将来的な課題について、次のような点につき考察を行った。第一に、離婚後どのような要件のもと、いかなる形態で、養育の共同性を認容することができるのかである。第二に、離婚だけでなく再婚も増加する中で、継親には、親権への関与、面会交流の可能性がどこまで認められるのかである。いずれの点についても、これまで比較の素材としてきたドイツ法における議論を参考に、日本法への示唆を得た。 | |||||||||

| 内容記述 | In this study, I considered the following points regarding the issues of custody and visitation. First, under what conditions and in what form can joint parenting be accepted after divorce? Secondly, as the number of divorces and remarriages increases, to what extent stepparents are allowed to be involved in custody and visitation. For both points, I have obtained suggestions for Japanese law by referring to the discussions on German law that I have used as material for comparison. | |||||||||
