| 内容記述 | 本研究は、主にイギリス憲法学における習律論や政治的憲法論を考察することにより、わが国制における習律の理論的根拠を解明するための手がかりを得るものである。第一に、わが国制にイギリスの伝統的習律論を採用する素地があるのか否かを考察する際の新たな視角を獲得した。第二に、J.A.G Griffithの政治的憲法論との対話を重ねれば、憲法典の存在が習律の否定に直結するという主張に対して何らかの応答をすることができるのではないかという示唆を得た。 | |||||||||

| 内容記述 | The purpose of this research is to acquire some clues on the matter whether the Japanese constitution recognises constitutional conventions through an inquiry into British constitutional theories. In the first place, this research brought a new approach to reveal whether the Japanese constitution could adopt a British traditional theory concerning conventions. Secondly, it suggested that a dialogue with J. A. G. Griffith, who advocated political constitution, might lead to challenging a contrary opinion which emphasised the existence of a constitutional code in Japan. | |||||||||
